Iphone 3G question upgrade?

In September 1.2008 moved from Verizon to ATT. I had some problems with my iPhone and Apple replaced it 3 times. Now that the new iPhone 3Gs left I want to ge 't, but the site atts i checked out my eligibility and its says that I can update in May 2009. My brother has an iPhone also and he had some problems and had to get replaced. He is able to update in September. Should I call ATT about it? Is that right? Can I update May 2010 my brother can in 2009.

I would like to call them for sure, but if he says you are eligible for an upgrade in May, then probably you are.
