Htc Phones for Sprint 2009

I want to upgrade my Samsung Instinct to a hero for HTC Sprint. How do I know when I do that?

I am sure I have the instinct back in January 2009. I'm really getting tired of their lack of resources and serious delay your music player. I saw the HTC hero and he come to Sprint, in mid-October and I want to upgrade. I can not wait until January, but at some point I have to wait a full 2 years after I got my instinct or just one year? And if there is any way to verify the exact date of the day, you can upgrade to any new phone? Thanks in advance for all serious answers
