Stolen Blackberry 9630 Tour, I can replace a switch to a new, if it is less than a month?

I recently bought a Blackberry Tour 9630 January 4, and it was stolen from me 2 weeks later, lodged a complaint through www.phoneclaim.com and asked them if the Tour Blackberry are send me will be refurbished or new. They said that since the Tour Blackberry has only recently been out for a few months they will be sending me a new box. I've been reading a lot analysis of phoneclaim.com they are thieves and unreliable. If this is the case and they sent me a defective phone, since I had my Blackberry for less than one month is possible for me to switch to a new one back into a local Verizon store?
